Ontario appeal court restores arbitrator’s fault ruling

In reinstating an arbitrator’s original award and overturning a Superior Court of Justice order for a 50-50 fault-split, the Court of Appeal of Ontario has reaffirmed the Fault Determination Rules chart used in insurance matters should override any application of the ordinary rules of tort law.

Ontario Works mess continues

The new software platform handles Ontario Works and Ontario Disability Support Program files and payments. Courts and junk science We need to take a much tougher look at so-called ‘expert testimony’ in our justice system

We’re kidding ourselves if we think civil litigation is immune from the junk science expert testimony problems we have seen in the criminal justice system. If anything, the problem is likely more pervasive in the civil justice system where the standard of proof is lower.
It’s time we held an inquiry into the use of junk science in both our criminal and civil justice systems and rooted out the experts who taint cases with junk evidence.
It’s not the science that is junk; it’s the “experts” who spew misinformation.

Regular use of a Truck Includes Recreational Tailgate Diving

Intact Insurance Company (FSCO A14-002957), Arbitrator Musson found that Intact was responsible for the payment of accident benefits to a young woman who had injured herself while diving into a shallow lake, with a considerable amount of alcohol in her system, from the tailgate of a stationary pick up truck, sometime after 2 a.m.

$80,000 Non-Pecuniary Assessment for Chronic and Permanent Low Back Injury

In today’s case (Gunson v. Sekhon) the Plaintiff was involved in a 2010 collision caused by the Defendant.  The plaintiff suffered a chronic and permanent low back injury.  The lingering symptoms caused some difficulties for the Plaintiff at work but did not outright disable him.

Tips on completing the OCF-18 Treatment Plan so you can get the treatment you deserve (Ontario)

After a serious car or motorcycle accident, chances are you will need a wide variety of treatment. Some of that treatment will be covered by Ontario’s OHIP Healtcare System. That means if you have a valid Ontario Health Card, it will be FREE.  Seeing a medical doctor (not a chiropractor or a psychologist), a hospital visit, and even treatment through the Community Care Access System (CCAC) is all covered.
