The new definitions for catastrophic impairment came into force for motor vehicle accidents that occurred on or after June 1, 2016. Currently, no cases under the new definition have been decided at the Licencing Appeals Tribunal (“LAT”). However, a review of the catastrophic impairment cases that have been decided since the commencement of the LAT do provide some guidance for the management of cases under the new definition.
