Supreme Court of Canada to hear appeal from Nova Scotia auto claimant over deductibility of Canada Pension disability payments

Andrew Sabean was injured in a vehicle accident near Bridgewater, N.S. in 2004. The other driver was inadequately insured. Sabean commenced an action under the SEF 44 (family protection endorsement) of his auto policy, written by Portage la Prairie Mutual Insurance Company.

The plan to reboot health care, home care in Ontario: Cohn

More than half of Ontarians cannot see their family physician within two days, and have trouble getting access outside office hours. The ministry wants LHINs to make doctors’ clinics more responsive by releasing their performance records to the public and requiring clinics to abide by contractual obligations — now rarely enforced — that would make them more accessible to patients (reducing costly emergency room visits).

OB/GYN Mistakes in Ontario Veiled in Secrecy

Just like the adage, “one bad apple spoils the bunch”, the wrongful actions of a few obstetricians have a costly effect on other OB/GYNs and the public. A Canadian investigation by the Toronto Star in conjunction with Ryerson University found that obstetrics is a unique field in which a relatively small number of doctors make serious mistakes but their mistakes are more impactful and tend to be committed repeatedly because the doctors are not caught.

Ontario passes legislation for injured workers, broader public sector and firefighters

The legislation will require the WSIB board of directors to appoint a fair practices commissioner to act as an ombudsman for injured workers, employees and WSIB service providers. It will help reduce the potential for disruption and delay for workers in the broader public sector when there are changes to bargaining units following certain events such as amalgamations or restructurings.

Ontario court authorizes class action against Toronto personal injury lawyer

The Divisional Court has certified a class action authorizing up to 6,000 clients of Toronto personal injury lawyer Gary Neinstein and his law firm, Neinstein & Associates, to participate in a lawsuit alleging that the firm entered into improper fee agreements, took unauthorized fees, failed to obtain required court approval and charged illegal interest rates on disbursements.

No Medical Report Thwarts Request for Second Defence Medical Exam

In today’s case (Thandi v. Higuchi) the Plaintiff agreed to be assessed by an orthopedic surgeon selected by the Defendant.  No report was produced following this assessment and the Defendant requested a further a exam with a neurologist.  In dismissing the application the Court noted that the lack of a report left the court without a proper evidentiary foundation respecting the equality of the playing field.

$3 Million “Diminished Capacity” Award For Brain Injured Teen Who Planned on Being Engineer

In today’s case (Grassick v. Swansburg) the Plaintiff, who was 16 at the time, was a pedestrian and struck by a vehicle driven by the Defendant.  The Plaintiff suffered a moderate to severe brain injury which impacted his cognition and was expected to have permanent repercussions.
